ReraFirst: MahaRERA Mandates Developers to Declare Parking Space Details in Agreements
In a major step to enhance transparency and prevent disputes, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed developers to clearly specify parking space details in sale agreements and allotment letters. This move aims to eliminate confusion and ensure that homebuyers receive well-defined parking spaces without facing future complications.
Reason Behind the Decision
MahaRERA’s decision comes in response to numerous complaints from homebuyers regarding parking-related issues, including:
- Building beams obstructing parking spots.
- Inability to park in the allotted slot due to space constraints.
- Insufficient space to open car doors after parking.
- Limited manoeuvring room, making parking difficult.
These complaints highlighted the need for precise documentation of parking spaces to prevent disputes between homebuyers and developers.
Mandatory Parking Details in Agreements
To address these concerns, MahaRERA has made it compulsory for developers to include detailed parking information in the annexures of the sale agreement and allotment letter. The model draft clause issued by the regulator requires the following information to be documented:
- Parking lot number assigned to the homebuyer.
- Exact dimensions of the parking space, including length, width, and height.
- Specific location of the allotted parking slot within the premises.
Strict Enforcement by MahaRERA
MahaRERA has emphasized strict adherence to this directive, ensuring that developers comply with the circular and the standard draft clause. The regulator stated that these measures will prevent homebuyers from facing inconvenience and frustration due to parking issues after moving into their homes.
“This standard clause is to prevent any ambiguity or disputes at a later stage and is mandatory for promoters to annex it with the allotment letter and agreement for sale,” MahaRERA said in an official statement.
By enforcing this rule, MahaRERA aims to protect homebuyers’ rights and promote transparency in the real estate sector.
